This is a 1997 overview of Alabama law pertinent to the privacy and security of criminal justice information.
Abstract

Alabama law provides that the Department of Public Safety shall provide criminal conviction information on applicants for positions that involve child care and treatment. Such requests may be granted when made by the Department of Human Resources or any other youth service agency approved by the department. Article 23 of the Alabama Code establishes the Alabama Criminal Justice Information Center, along with a commission to administer the Center. The Center is responsible for the collection, storage, retrieval, analysis, and dissemination of vital information relating to certain crimes, criminals, and criminal activity. The law provides that disclosure of criminal histories or other information that may directly or otherwise lead to the identification of the individual to whom such information pertains may not be made to any person, agency, corporation, or other legal entity that has neither the "need to know" nor the "right to know" as specified by the commission pursuant to Alabama law. There are provisions for purging, modifying, or supplementing criminal records. Also included in this compendium is an act that requires the dissemination to the Department of Pensions and Security of any history of prior felony convictions for applicants for adoption or foster parenting. This compendium contains administrative procedures for issuing new or revised privacy and security regulations as well as the procedure for appealing existing regulations. Other regulations presented pertain to criminal history dissemination policies and procedures, procedures for personnel security, and physical security standards for the Criminal Justice Information Center.
