The NICS Improvement Amendments Act of 2007, Pub. L. 110-180 ("NICS Improvement Act"), was signed into law by the President on January 8, 2008. The NICS Improvement Act amends the Brady Handgun Violence Prevention Act of 1993 ("the Brady Act") (Pub. L. 103-159), under which the Attorney General established the National Instant Criminal Background Check System (NICS). The Brady Act requires Federal Firearms Licensees (FFLs) to contact the NICS before transferring a firearm to an unlicensed person for information on whether the proposed transferee is prohibited from receiving or possessing a firearm under state or federal law. The NICS Improvement Act authorizes grants to be made in a manner consistent with the National Criminal History Improvement Program (NCHIP).

Under this award, the New York Division of Criminal Justice Services (DCJS) and its partner agencies will complete tasks related to five (5) projects:

1) Continue efforts to support the New York NICS Record Improvement Task Force's ability to define and address NICS improvements with participating agencies;

2) Improve the completeness and accuracy of court orders of protection data submitted to the National Crime Information Center (NCIC), provide disqualifying court orders to the NICS Index, and identify and submit to the NICS Index records for convictions of misdemeanor crimes of domestic violence;

3) Identify problems and solutions for missing dispositions using the State Estimates of Available Records Information Collection as a baseline for analysis;

4) Improve the tracking of involuntary admissions to the Department of Health, State and Office of Mental Health Licensed Adult Inpatient Facilities, and Civil Guardianship records through the Office of Court Administration and increase the availability of these records to the NICS Index; and

5) Continue to improve data interfaces between NICS, DCJS, and the Office of Mental Retardation and Developmental Disabilities for the inclusion of mental health records.
